I Just Received a Notice of Bankruptcy

If you have received a Notice of Commencement of a bankruptcy case read the instruction attached to the notice.  It sets out your obligations and legal responsibilities after you know about a bankruptcy filing.  If you have not gotten a notice from the court and need instructions about how to proceed, click the green button to be directed to a proof of claim form and instructions.  WARNING:  YOU MAY NOT PICK UP ANY PROPERTY WITHOUT COURT PERMISSION REGARDLESS OF WHETHER YOU HAVE RECEIVED A PAPER NOTICE.

Verification of Bankruptcy Filing and Representation

You may obtain bankruptcy filing verification by registering for a Public Access to Court Electronic Records account on the PACER Service Center web page. Select “Register for PACER”.

http://pacer.psc.uscourts.gov.

Alternatively, you may get up date filing information from the Voice Case Information system at 866-222-8029.

Can you tell me the terms of the debtor’s plan?

Plan details may be obtained through the Public Access to Court Electronic Records account on the PACER Service Center web page. Select “Register for PACER”. http://pacer.psc.uscourts.gov.

Can I contact the debtor directly?

Unless you have received court authorization to talk to the debtor directly, the answer is no.  You must forward all communication through my office.  Failure to comply with the bankruptcy court’s automatic stay protection may mean the creditor may be held in contempt.
